Question about Child Support & Self Employed Income?

Went to court yesterday for a pre-trial conference for my ex-husbands request to have his child support modified. Since we were not able to come to an agreement the judge is moving it to trial.
The finical statement he submitted to the court claimed he was making $132 a week income as being a self employed machinist
The judge didn’t seem to think that was accurate so he told me to file a contempt for unpaid child support and that they will look at his books bank records credit card records and lifestyle and go to trial to determine if and how much his child support should be modified
Will I be able to see all of this information (bank records and such) or is this only for the courts use?
Will they allow him to use his net income even if they included unreasonable expenses (almost $5000 in entertainment expenses over $4000 in office expenses $6500 in car expenses (he drives a 1999 honda and uses it for personal uses as well)
It’s up to the court but more than likely you’ll see it during the hearing.

Yes, you’ll get to see it. It’ll get sent to your lawyer and you can ask him.

No, you won’t get to see his information only the attys and judge…and it will be based on his net income….

As I understand it, bank records are protected under privacy laws. You will need a court order to look at them. The court can access bank records if they have just cause..
I work as a Freelancer for a number of years. I do my own taxes also. I would suggest requiring copies of the past 3 years of federal tax papers. That should give a better idea how much he makes.

humm… well that definatly not alot of money he says he making
but i dont think you should get to see his bank information
i mean.. are you going to bring your bank information so he can see what you spend?
are you going to provide an accurate budget of what is ACTUALLY needed for child support.. how much it actually costs to raise the kids.. rather than what you feel like you want??? Or if you did that would he see that you just want his money and spend it on stuff other than the kids..
if you dont great… but if you expect to see his bank information and what he spends money on i would say its only fair that you show him the same so he can see what his child support money is being spent on…………………

If he is trying to dodge paying you child support he is probably veiling any proof if income !

My ex and I went through this and my lawyer filed a motion for Discovery. He had to show 3 years tax returns, 1 year of bank statements, 3 months of pay stubs plus fill out a financial declaration. But in return, I had to show all of the same information. We both got to see each others and review them with our lawyers.
